The Interpretours / Guidetags digital interpretive platform ("the platform") consists of an integrated web-based content creation and editing platform ("Interpretours") and an associated digital app ("Guidetags" or “the app”) designed to deliver geolocated multimedia content to mobile device users in the field.

Collectively, they are referred to as “the Interpretours / Guidetags digital interpretive platform” or “the platform”.

USE OF THE INTERPRETOURS / GUIDETAGS DIGITAL INTERPRETIVE PLATFORM IS ENTIRELY AT YOUR OWN RISK.

USE OF THE INTERPRETOURS / GUIDETAGS DIGITAL INTERPRETIVE PLATFORM IS GOVERNED BY ALL APPLICABLE LAWS AND REGULATIONS IN THE JURISDICTIONS WHERE THEY ARE USED.

All materials (“online digital resources “) on the Interpretours / Guidetags digital interpretive platform (including maps, guides, multimedia resources, photos, text, and all other digital information) have been developed to assist users to find, visit, interpret, and understand local landscapes, sites of natural and cultural heritage, and other locations and destinations in various ways, including visiting sites of interest, learning about their attributes and history using online digital resources and participating in relevant events and activities. All online digital resources on the Interpretours / Guidetags digital interpretive platform are provided free of charge on an "as is" basis. We take no responsibility for the accuracy of, use of, misuse of, inability to use, or reliance upon, the platform, including the app, the websites, and / or associated content, including links to external websites, services, or APIs.

Your use of the Interpretours / Guidetags digital interpretive platform, including the app, the websites, and all linked or associated materials, is solely at your own risk. All activities when travelling to or visiting any of the destinations are solely at your own risk. Environmental, road, weather, traffic, trail, and other conditions at locations and destinations portrayed on the Interpretours / Guidetags digital interpretive platform vary continuously, and you are advised to exercise extreme caution at all times when travelling to or visiting them. You are also advised to contact local authorities to confirm the current condition and status of locations, destinations, roads, trails, and cycling routes before commencing any trip. You are also advised to consult a qualified medical adviser before commencing any physical activity associated with the Interpretours / Guidetags digital interpretive platform.

Use of the Interpretours / Guidetags Digital Interpretive Platform On Mobile Devices

Follow all applicable laws and regulations regarding display, placement, use, and interaction with mobile devices (smartphones, tablets, smart watches, etc.) when walking, or in vehicles of all types, motorized or non-motorized, according to the jurisdictions where you are using them. Do not read or view mobile device screens, maps or multimedia content while walking, driving or cycling. Do not hike or cycle alone. Inform others of your route, and carry a cell phone in case of emergency. Respect the rights of local residents and property owners, and do not trespass. Follow proper trail etiquette and park regulations. Walk, cycle and drive safely; obey the rules of the road; and wear a bicycle helmet when cycling.

Indemnity

The owners, content creators, paid and unpaid contributors, and all users of the Interpretours / Guidetags digital interpretive platform ("the parties") will severally indemnify and save harmless the other parties including their respective officers, directors, employees, agents and students from and against any and all suits, claims, demands, costs, damages, expenses, losses or injuries (including death) to persons or property caused by the use of the platform, or by the breach, wilful or negligent act or omission of the indemnifying party and its officers, directors, employees and agents during the use of the Interpretours / Guidetags digital interpretive platform at any time.

Limitation of Liability

In no event will a party be liable to the other for loss of business or profit or for any special, indirect, punitive or consequential loss or damage, regardless of whether such loss or damage arises under contract, tort, or based upon strict liability or other theory of law or equity, where such loss or damage arose in connection the Interpretours / Guidetag platform. More particularly:

  1. All content, services and deliverables provided by each party are provided “as is” with no warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement;
  2. In no event shall each party, be liable for lost profits or revenue, business interruption or loss of goodwill or for any indirect, incidental, special, consequential, exemplary or punitive damages even if each party has been advised of their possibility.
There are no conditions, representations, warranties, undertakings, promises, inducements or agreements, whether direct or indirect, collateral, express or implied made between the parties concerning the use of the platform, the subject matter thereof, the subject matter in this Disclaimer, or any other matter embodied herein.

Force Majeure

Notwithstanding anything to the contrary contained herein, the Parties will not be liable or be deemed to be in breach of this Agreement for any failure or delay in rendering performance arising out of causes beyond its reasonable control (a "Force Majeure Event"). Such causes may include, but are not limited to, acts of God, governmental regulation or control, shortage of supply, breakdowns or malfunctions, interruptions or malfunction of computer facilities, loss of data due to power failures or mechanical difficulties with information storage or retrieval systems, labor difficulties, war, acts of nature or of a public enemy, acts of terrorism, mass-casualty event, fire, flood, local, regional or global outbreak of disease or other public health emergency, social distancing or quarantine restriction, strike, lockout or labour or civil unrest, freight embargo, unusually severe weather, failure of public utility or common carrier, or computer attacks or other malicious act, including attack on or through the internet, or any internet service, telecommunications provider or hosting facility.

The Interpretours / Guidetags digital interpretive platform ("the platform") consists of an integrated web-based platform ("Interpretours") and an associated digital app ("Guidetags") designed to deliver geolocated multimedia content to mobile device users in the field.

Using the platform involves the processing and storage of anonymous data collected on the app, the websites, or via third-party analytical tools used in conjunction with the platform.

We have created this Privacy and Personal Data Protection Policy in order to communicate our policy and practices regarding the collection, use and disclosure of information which is obtained during your use of the platform.

Please read this Privacy Policy carefully. It may be modified at any time.

If you decide to use the Interpretours / Guidetags digital interpretive platform, you consent to the collection and use of information under the conditions set out in this Privacy Policy. We collect anonymous information from you when you enter information on our website or interact with our app.

One exception to this is if you use Game mode (see below), where user aliases may be associated with analytics parameters.

When using the GuideTags mobile app, we collect information about how the app is used, including, but not limited to the following:

All Guidetags sessions (Discover, Tour, Game, Find modes) are anonymously tracked once they are started, even if you visit no points of interest.

How do we use your anonymous information?

We may use the anonymous information we collect from you when you register a user account, sign up for our newsletter, respond to a survey or marketing communication, surf the website, use the mobile app, or use certain other site features in the following ways:

Information Collected in Game Mode

If you elect to interact with the GuideTags app in Game mode, you will be asked to choose a 1-5 character user alias (player name) which identifies you as a game participant. This user alias will appear along with your score on the Game Leaderboard. Unlike analytics data, information associated with your user alias is NOT completely anonymous. At our sole discretion, we reserve the right to delete user aliases from the Leaderboard and database that we consider inappropriate or offensive, including associated scores and analytics information.

Security

The Interpretours / Guidetags digital interpretive platform has implemented security measures to protect the personal information you provide against unauthorized access and use.

Please be aware, however, that no data transmission over the internet is 100% secure and all information communicated online may potentially be intercepted and used by others than the intended recipient.

The content that is developed as a result of these collaborations is not anonymous, and is under our editorial control. We know the identity of our content creators. Collection of data from minors

Canada passed a comprehensive privacy bill, the Personal Information Protection and Electronic Documents Act (PIPEDA). However, it does not have a law specific to children's online privacy. In the USA, the COPPA (Children Online Privacy Protection Act) puts parents in control of the collection of personal information from children under the age of 13 years old. The US Federal Trade Commission, the federal consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children's privacy and safety online. We follow COPPA practices, and do not specifically market to children under the age of 13 years old, or let third-parties, including ad networks or plug-ins collect PII from children under 13.

Information Collection Guidelines and Fair Information Practices

Canada’s comprehensive privacy bill, the Personal Information Protection and Electronic Documents Act (PIPEDA), outlines how information is collected and stored. We follow the general provisions of PIPEDA.

The Fair Information Practices Principles form the backbone of privacy law in the United States, and the concepts they include have played a significant role in the development of data protection laws around the globe.

In order to be in line with Fair Information Practices, if we are in possession of personal information collected with your permission, we will notify you via email within 7 business days should a data breach occur.

We also agree to the Individual Redress Principle which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.

CAN SPAM Act

The U.S. CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out penalties for violations.

Changes and updates to the Privacy Policy

This Privacy Policy reflects the professional practices in force within the Interpretours / Guidetags digital interpretive platform, and it may be modified and updated. In the event of modification or update, the revised Privacy Policy will be posted on the www.guidetags.com website, with mention of the last update date. Please check the www.guidetags.com website regularly to stay informed of any changes or updates to the Privacy Policy and practices.

Deletion of User Data

If you use the Interpretours / Guidetags digital interpretive platform, you can request your user data to be deleted. To do so, please find your anonymous Analytics ID by visiting the settings menu within the mobile app, and selecting "Review Privacy Policy". There, you will see a randomly assigned Analytics ID listed by the top of the display. Please email your request for deletion, along with the Analytics ID to app@interpretours.com.

Please note that the Analytics ID may change when the app updates, or when you install or re-install the mobile app. If you decide to use the app but think that you may want to delete any analytics data in the future, please be sure to record your Analytics ID whenever the aforementioned situations occur. If you do not record the analytics ID, GuideTags cannot guarantee that the anonymous data associated with that ID can be deleted from the system. In all cases, however, there will be no link between the analytics data and your personal identity at any time.

Please allow us at least 10 business days to respond to your request for data deletion.

We may retain copies of communications with you, and any responses to questions or comments sent for archival purposes.

3. OWNERSHIP, COPYRIGHT, AND INTELLECTUAL PROPERTY POLICY

The Interpretours / Guidetags digital interpretive platform ("the platform") consists of an integrated web-based platform ("Interpretours") and an associated digital app ("Guidetags") designed to deliver geolocated multimedia content to mobile device users in the field. It is a joint venture founded and owned by David T. Brown, Gabriel Dabrowski, and Caroline McCormick ("the owners").

Intellectual Property

  1. "Background Intellectual Property” means, individually and collectively, all Intellectual Property that is relevant to the Interpretours web-based platform and the Guidetags website and app, and has been created, discovered, developed, produced, purchased, contracted for, or otherwise obtained by the owners.
  2. “Foreground Intellectual Property” means, individually and collectively, all new or potential Intellectual Property that is being developed for the Interpretours / Guidetags platform, including any improvement, enhancement or modification to Background Intellectual Property, without limitation.
  3. “Intellectual Property” means intellectual property rights in any jurisdiction, whether registered or not, including but not limited to: (i) inventions, pending patent applications and patents which may be issued from current applications (including divisionals, reissues, renewals, re-examinations, continuations, continuations-in-part and extensions) and issued patents: (ii) trademarks, service marks, logos, trade dress, trade names, business names, domain names and other indicia of origin; (iii) copyrights and all other rights of authorship and all applications and registrations in connection therewith; (iv) industrial designs, design patents and similar rights and all applications, registrations and renewals in connection therewith; and (v) trade secrets.

Ownership of Background Intellectual Property

All right, title and interest in Background Intellectual Property is and shall remain the sole and exclusive property of the owners, except where governed by other legal agreements.

The rights to any background content that originated from other sources, and that are cited, referred to, or quoted on the Interpretours / Guidetags digital interpretive platform, remain with the original content creators.

Ownership and License of Foreground Intellectual Property

All rights, title, and interest in any Foreground Intellectual Property shall belong to the party that developed that Foreground Intellectual Property, as applicable, EXCEPT for intellectual property which is or was created on behalf of the Interpretours / Guidetag platform by remunerated writers, artists, programmers, developers, or other digital content creators ("contributors") for a fee.

No party shall sell, transfer, assign, gift, lease, license, sublicense, commercialize, dispose of, or otherwise commercially exploit any Foreground Intellectual Property without the express written agreement of the other Party.

Any content or Foreground Intellectual Property developed for use on the Interpretours / Guidetag platform according to other valid existing agreements shall be governed by the terms of those agreements.

The rights to any foreground content that originates from other sources, and that are cited, referred to, or quoted on the Interpretours / Guidetags digital interpretive platform, remain with the original content creators.
